Our service, available through the website and/or software application (“Service”), empowers you to effortlessly transfer funds between your mobile money wallet and bank account, as well as to the wallet/account of another user. Additionally, it enables convenient payments for products and services offered by third parties, all through your supported mobile money wallet, account, or debit card.

Your financial convenience and security are our top priorities. By using the Service, you agree to adhere to the Terms of Service (“Terms”) outlined below. We appreciate your trust in KashRite as we strive to provide you with a user-friendly and secure platform for all your payment transactions.

Terms of Service

Your use of the KashRite service constitutes a contract between you and KashRite. If you do not agree to these terms, please refrain from using the Service. By accessing any part of the Service, you automatically acknowledge and accept these Terms. If you are under eighteen (18) years of age, you may not use the Service.

To access the Service, you are required to register an account with accurate information. By using the Service, you expressly agree to: (a) provide a valid mobile phone number; (b) create an account associated with the provided number; (c) accept the existing Terms; and (d) submit any additional information as requested by KashRite to comply with regulatory and legal requirements. You commit to providing true, accurate, and complete information about yourself. Safeguarding your Personal Identification Number (PIN) is your responsibility. KashRite cannot be held responsible if you compromise your details by disclosing them to third parties.

Third-Party Merchants

The Service offers an opportunity to discover offers from independent third-party merchants (“Merchants”). Merchants sell their respective products subject to their own terms and conditions. If you choose to purchase products from third-party Merchants, you do so at your own risk and subject to the relevant Merchant’s terms and conditions. KashRite is not responsible or liable for the products you purchase from Merchants.

Payments Processed by Third Parties

To facilitate your purchases from Merchants, KashRite has integrated its Service with the billing solutions of third party service providers and financial institutions (“Providers”). These providers have their own terms and conditions governing your use of their payment services.

Privacy

Your privacy is important to us. KashRite’s privacy policy governing the Service is attached to these Terms (“Privacy Policy”). The Privacy Policy is incorporated into these Terms by this reference. By using the Service, you agree to the use of your data in accordance with KashRite’s Privacy Policy.

Product Inquiries and Complaints

If you have any questions, concerns, or requests related to a product you have purchased from a Merchant, please contact the Merchant directly or contact us at support@kashrite.com for assistance. KashRite will do its best to assist you.

Prohibited Use

You must not use the Service to violate any laws or infringe on the rights of any person, including other users, KashRite, or Merchants. In the event that KashRite reasonably suspects that you are using the Services for illegal activities, KashRite reserves the right to block your account immediately without liability.

Communication from KashRite

You agree that, as part of the Service, you may receive communications from KashRite via email, instant message, telephone, text message (SMS) or other means. You may choose to opt out of receiving promotional messages but may not opt out of receiving service-related messages.

Discontinuation of Service

KashRite may terminate your access to the Service or cease its provision for regulatory, time-sensitive, or security-related reasons, with due notice to you. We will make every effort to provide notice in a timely manner and restore the Service at the earliest convenience. In the event of such termination, you agree that KashRite shall not be held responsible or liable to you or any third party.

Service Disclaimer

The Service is provided “as is” without any warranty of any kind. KashRite and its suppliers and affiliates disclaim all warranties with regard to the service, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. If you are dissatisfied with any portion of the service or these terms, your sole and exclusive remedy is to discontinue using the service.

Limitation of Liability

In no event shall KashRite or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever arising out of, or in any way connected with the use or performance of the service.

Governing Law and Dispute Resolution

This Agreement shall be governed by, and construed in accordance with the laws of Nigeria. Any disputes shall be submitted to arbitration before a sole arbitrator to take place in Lagos, Nigeria, and conducted pursuant to the Rules of Arbitration of the Chartered Institute of Arbitrators of the United Kingdom.

Modification of Terms

KashRite may modify these Terms, and related policies at any time. By continuing to use the Service, you agree to be bound by these Terms.

General Provisions

No alteration, variation, or agreed cancellation of this agreement shall be of any effect unless directed by us. This Agreement constitutes the whole agreement between the parties. No relaxation or indulgence shown by KashRite shall prejudice its rights. Each provision of this Agreement shall be deemed separate and severable from the others. If any provision is found invalid, the remaining provisions shall remain in full force and effect.
